Direct Action – Number 3

Over the last two nights I undertook the Lincolnshire Direct Action Number 3 at Huttoft Car Terrace with numerous friends in approximately 15 motorhomes over the two nights. For the third and fourth time I did not receive a Level 2 fine. As such this clearly confirms that Lincolnshire County Council have no legal authority to issue a fine for the reasons that I undertook the direct action in this location.

Time Parked/Slept At Location

From 13.30 Friday 21 until 12.00 Sunday 23 February. During this time I spent the two nights on the car terrace; time at the side of the road leading up to the car terrace; did media interviews; consulted with Lincolnshire Police and undertook further investigations in the area.

Observations

  1. Clear nights with a glorious moon on the first night.
  2. On the second night I had the car terrace to myself once the “interior light cars” ceased to arrive after 23.00
  3. Police patrol at 19.45 on the first night.
  4. At night numerous short visit cars with interior light on for up to 15 minutes.

Reasons For Direct Action

  1. Byelaw is in breach of legislation.
  2. Height Barrier is in breach of legislation.
  3. Height Barrier is in breach of disability legislation.

Conclusion

  1. LCC accept that the bye-law is in breach of legislation.
  2. LCC accept that the height barrier is in breach of legislation.
  3. LCC breached the right of my friends, including three with disabilities, to park in the car park from 06.00. A complaint will be submitted to LCC for these breaches especially the breach of disability legislation.
