The company of heavies that Lincolnshire County Council have employed to intimidate lawful people, parked between the hours of 22.00 and 06.00 at Huttoft Car Terrace, is called Lincolnshire Security Ltd.
The Lincolnshire Byelaw for Pleasure Grounds, Public Walks and Open Spaces states in Part 4/7 (2):
Neither Lincolnshire County Council, Lincolnshire Police or Lincolnshire Security Ltd can state who is, or is not, acting lawfully. Only a court of law can determine this. Until a court of law rules that a person has acted unlawfully (since all UK citizens are innocent until proven guilty), everyone is acting lawfully.
As such, and as per Part 4/7(2) of the byelaw, Lincolnshire Security Ltd cannot approach anyone parked at Huttoft Car Terrace between the hours of 22.00 and 06.00 as to do so is itself a breach of the byelaw. Of course, they may collect motorists registration numbers in the same way a five-year old can.
I believe that the DVLA must not supply the details of the registered keeper to Lincolnshire County Council if Lincolnshire Security Ltd, Lincolnshire Police or anyone else who may have breached Part 4/7(2) while in the process of recording the vehicle registration number. I believe if this information is provided by the DVLA, the DVLA will have breached the Data Protection Act. In addition, any information recorded while breaching Part 4/7(2) cannot be used in a court of law, as the law may not be broken to enforce the law.
On the evening of Friday 18 August myself and the owners of a 4×4 and two motorhomes were approached by Lincolnshire Security Ltd in breach of Part 4/7(2). I have referred the matter to Security Industry Authority (SIA) and requested their immediate intervention.
For reasons unknown, on the evening of Friday 18 August Lincolnshire Securities Ltd phoned the Police for assistance at Huttoft Car Terace. The Police confirmed that this was a civil matter and nothing to do with the Police. This resulted in the waste of Police resources as two Officers attended, in two cars, to no purpose.
