I appreciate the campaign regards the Huttoft Car Terrace is rather confusing. The following is a brief summary.
Huttoft Car Terrace is a delightful place on the Lincolnshire coast that until recently allowed access to the beach for everyone, especially those with disabilities.
Lincolnshire County Council (LCC) invented a problem that does not exist. Despite claims made to the BBC and ITV of hundreds of complaints with regards the coastal car parks there are only 24.
On the basis of these 24 complaints LCC Principal Solicitor stated: “There are continuous problems – mainly throughout the warmer season – with people camping(with motor homes etc) and parking overnight. This is having an impact on the residents in the area as they are being subjected to noise, nuisance, excessive litter, fires from campfires, and verbal abuse from some of the people camping”.
Did you see the jump? Who says the stated issues are due to motorhomers? Fabrication. But this does not prevent LCC introducing a byelaw to prevent overnight parking in numerous coastal car parks by using legislation that cannot be used for a car park.
Furthermore, the Department for Communities and Local Government (DCLG) approved this byelaw. Based on this evidence the DCLG could have signed off hundreds of byelaws that should not be in place. These are preventing law-abiding UK citizens going about their lawful business.
LCC on the basis of this byelaw have stated they have issued 40 summonses. Yet not one person has received a summonses three months after this statement was issued.
Then there are the fisherman’s permits, of which I own one, that allows overnight parking. Who is to say that one of the 150+ fishermen issued with a permit are not subjecting local residents to “noise, nuisance, excessive litter, fires from campfires, and verbal abuse” ?
I am now being informed that the height barrier will be erected for a fourth time (all three previous ones have been removed by persons unknown) within the next two weeks.
LCC have wasted £150,000 to deal with litter. Which, if there is an issue with litter, is an offence committed by LCC themselves as per the Environmental Protection Act 1990.
So why have LCC spent £150,000 dealing with an offence that they are guilty of committing? Why didn’t they employ litter pickers, put in more litter bins or empty the current bins more regularly
My Stated Position
I can park a car, white van or motorhome overnight at any of the coastal car parks including Huttoft Car Terrace and Lincolnshire County Council will never be able to prosecute me as I would be acting lawfully.
If the height barrier is replaced my campaign against the byelaw and the illegal height barriers will be escalated.
