Today I returned to Boston Magistrates Court.

Boston Court

Case A

  • Name – Alex
  • Number of charges – 2
  • Plea – Not Guilty

A trial will now commence on Thursday 2 April 2015.

Case B

  • Name – Jamie
  • Number of Charges – 3
  • Plea – Guilty

The plea of guilty was not because Jamie was guilty but because this is “trial by bank account“. Jamie has two young children and was faced with a fine of a few thousands if found guilty after pleading not guilty or a few hundred if he pleaded guilty.

Lincolnshire County Council wanted the maximum £500 fine for each charge plus costs.

In the end the three magistrates were a credit to the UK Judicial System they charged him £75 on the first count, nothing for the other two charges and awarded £100 costs against him with a £20 victim support. Total £195

Case C

  • Name – Gary
  • Number of Charges – 2
  • Plea – Guilty

Although we did not pay for Garys legal defence we were in a position to offer advice.

Like Jamie the plea of guilty was not because he was guilty but because this is “trial by bank account”. Gary was faced with a fine of a few thousands if found guilty after pleading not guilty or a few hundred if he pleaded guilty.

Lincolnshire County Council wanted the maximum £500 for each charge plus costs.

In the end the three magistrates were again a credit to the UK Judicial System they gave him an absolute discharge due to Lincolnshire County Council failing to provide sufficient evidence to Gary when he parked on Huttoft Car Terrace.

Conclusion

Even with two guilty pleas Lincolnshire County Council where only successful in one of the five charges they brought. What an appalling return on investment for the tax payer.
