Councillor Alan Broughton is a Huttoft Parish Council Councillor. He has declared his pecuniary interests on his Register of Interests. He states that he is retired. By stating this, Councillor Broughton has committed a criminal offence under the Localism Act 2011, as he is making a false declaration.

This invoice is dated 15 March 2013. Both are dated after Councillor Broughton stated that he was retired. Obviously, he is still operating a business.

Councillor Broughton was paid £50 for a days work by Lincolnshire County Council when the minimum wage at the time was £6.19, £49.52 per day. As a contractor Councillor Broughton has expenses. Unless his gross operating expenses are less than 48 pence per day (£175.20 per year), Lincolnshire County Council (LCC) have employed a contractor at below minimum wage.
Furthermore, if Lincolnshire County Council allowed 30 bags of litter to build up at Huttoft Car Terrace, they have breached their duty under the Environmental Protection Act 1990 as:
“It shall be the duty of each principal litter authority, as respects its relevant land, to ensure that the land is, so far as is practicable, kept clear of litter and refuse.”
Allowing 30 bags of litter to build up is clearly in breach of the EPA 1990.
Litter was the main issue stated for the introduction of the Lincolnshire Byelaw for Pleasure Grounds, Public Walks and Open Spaces. The above evidence clearly demonstrates that LCC should not have introduced the byelaw, as employing Councillor Broughton was a way:
“of addressing the situation at which the byelaws are directed”
in a cost-effective manner – below minimum wage.
